Acceptance. Your acceptance of each and all of these terms and conditions shall be indicated by any of the following, whichever occurs first:
a. By clicking the “I ACCEPT” button below;
b. By your written acknowledgement of these terms and conditions;
c. By your acceptance of any shipment of any part of the items specified for purchase or delivery by you to US Sander;
d. By your placing any order for products or services over this Website, Phone, Email, Fax; or
e. Any other act or expression of acceptance by you.
All prices and availability are subject to change without notice. Some items are not in stock, and may take longer to get.
We are not able to research special parts. This is time consuming and subject to problems. If you call us with the manufacturer's part number, in most cases we will be able to special order it for you. There are a few manufacturers we do not handle parts for, such as Primatech nailers. All special order items require payment in advance.
We make no guarantee that any items listed on our site will be available or in stock. If any items on your order are out of stock, the entire order will be placed on hold until all items are ready to ship. If these items showed in stock at the time your order was placed, we will send you an email notifying you of the delay.
You can have us ship the in-stock items at any time. You can then either cancel the out of stock items, or they will be placed on backorder. If the items are not in stock and will be out of stock for an extended period we may ship the in stock items and backorder the out of stock items. If they are backordered, you will have to pay the additional shipping cost when they do ship. Shipping is only estimated till the order is invoiced and may change due to many factors including but not limited to additional UPS fees from additional zone fees, dimensional weight fees, or additional UPS fees charged to us and not calculated till the final package is processed, weight changes due to packaging, etc.
Payment is by credit card. Your card will be authorized for the order total when you place it. Your card will be charged for the invoice amount when items ship. Therefore, you are only charged for the items that ship, when they ship.
When you place an order, your credit card information will be transmitted to our payment processor, where it is saved to be charged when the order ships.
By calling and placing an order with us, you are authorizing us to ship the items to you and agreeing to pay for them. Coupon codes are not valid on phone orders: they are for internet orders only.
Phone orders must be placed using our part numbers. If our part numbers are not given we will as a courtesy and time permitting look up part numbers for you. When we look up a part number we do not guarantee that it will be the correct part you need, only that based on your description it is what we believe you require. We only guarantee that the item we send matches the corresponding part number invoiced. If this item is not what you require you will be responsible for return shipping. Please order by our part number.
Payment is by credit card or COD. Unless you specify otherwise, we will keep your credit card on file for your convenience on future orders.
COD orders will be subject to a COD fee. If you refuse a COD shipment, we will not ship anything to you until you pay the fees associated with the COD shipment. If you refuse a COD shipment twice, we will not ship COD to you again.
Shipping is only estimated till the order is invoiced and may change due to many factors including but not limited to additional UPS fees from additional zone fees, dimensional weight fees, or additional UPS fees charged to us and not calculated till the final package is processed, weight changes due to packaging, or options required for delivery etc.
Delivery;Title; Risk of Loss. Title to products passes to the Customer on shipment from our facility. US Sander LLC shall not be liable for any delays in delivery beyond the reasonable control of US Sander including, but not limited to, delays caused by unavailability or shortages of product components from US Sander LLC suppliers, natural disasters, acts of war, acts or omissions of Customer, fire, strike, riot, governmental interference, unavailability or shortage of materials, labor, telecommunications, fuel or power through normal commercial channels at customary and reasonable rates, failure or destruction of plant or equipment arising from any cause whatsoever, transportation failures or computer-related transmission failures.
We offer free ground shipping for online orders shipping to the 48 contiguous states (not Alaska, Hawaii or international destinations). Orders with free shipping may take a few days to process during busy times - if you need the items quickly, select a different shipping method.
Free shipping is for orders placed online only. Orders paced by phone, fax or email will be charged shipping.
You must select the free shipping option at checkout for this to apply. Free shipping orders will ship by UPS or FedEx.
While we try to keep most common items in stock, we sometimes run out due to unexpected high demand or supply delays. If this is the case, you will see a notice at checkout indicating certain items are not in stock. An estimated shipment date is provided, but this is not a firm date. (This date is based on how long it typically takes to get the item, and does not take into account inventory we have ordered but not gotten yet. Typically items will ship sooner, but in some cases later, than the estimated date.)
For domestic orders, you will be given 3 options:
- Ship what is in stock now, and the backordered items when available.*
- Ship everything together when it is all available
- Ship what is in stock and cancel the backordered items
* If this option is chosen, backorders will ship when all the items are available. They will ship by ground, even if you chose a faster shipping method at checkout (the first shipment is sent by your chosen shipping method, but not the backorders).
For smaller orders there is a fee for shipping stock and backordered items later. This fee is to help offset the shipping costs for the second shipment.
For international orders, we will always ship complete when everything is available.
Payment is to be made in advance of shipping your order. We do not offer open accounts. Credit card payment is preferred. Personal or business checks must clear our bank first before we will ship. This could take up to two weeks additional to clear our bank.
US Sander must collect sales tax for orders shipping to certain states. The only exception is if we have a valid tax exempt certificate on file. If we do not collect sales tax on an order, that does not mean sales tax is not due. For orders shipping to states in which we do not collect sales tax, the purchaser is responsible to file and remit the sales tax.
Sales delivered or sourced to Washington:
Sales or use tax is due on certain purchases delivered or sourced to Washington. Washington requires you to file a use tax return when sales tax is not paid at the time of purchase. This message is required under the Revised Code of Washington 82.13.020(2)(a)(i).
Sales delivered or sourced to other states:
Sales or use tax may be due on certain purchases delivered or sourced to your state. You may be required to file a use tax return when sales tax is not paid at the time of purchase. It is your responsibility to comply with the sales tax laws of your state if sales tax was not charged at checkout.
Products shipped outside of the U.S. may be subject to taxes, customs duties, and fees charged by the authorities of the country of importation ("Import Fees"). You are responsible for paying all Import Fees. You are the person responsible for the import clearance of products shipped outside of the U.S. ("importer of record"), unless the laws of the country of importation require that someone else serves as the importer of record. In that case, you give permission for US Sander to designate an importer of record. You also authorize US Sander to designate a carrier ("Designated Carrier") to act as your direct or indirect representative/agent with the relevant customs, postal, and tax authorities, to clear your products, to process and pay on your behalf any Import Fees charged for your products ("Actual Import Fees"), and to process any amendments, invalidations, or duty refunds or remissions related to the importation of your products. You agree that the Designated Carrier may disclose to US Sander the amount of Actual Import Fees for the products purchased from US Sander. Following shipment of your order, you may contact the Designated Carrier specified in your invoice to obtain details regarding the Actual Import Fees, or to obtain documentation or receipts in connection with customs clearance.
All shipments will use the carrier's customs broker for import clearance by default. If you would like to use your own customs broker, please contact us to have your account set up to use this broker. This will apply to all shipments by FedEx and freight carriers. To use your own customs broker on UPS shipments, you will need to contact UPS directly. USPS (US Mail) does not allow using your own customs broker.
Any new machine not in stock must be paid for before we will order it. New machine orders cannot be canceled after we have ordered them. New machine warranties will be subject to the manufacturer's terms & conditions. Returns on new machines are subject to our approval.
Used machines are sold as is with no warranty. We guarantee they will run and operate. There are no returns on used machines.
Rebuilt machines have been inspected and any worn parts replaced, as well as all the bearings. They come with a 30 day warranty.
Surplus inventory is sold as is, with no warranty or guarantee. We do not allow returns on surplus inventory. The only exception is where the wrong lot was sent or the wrong photo used to display the item. No other returns will be allowed.
We occasionally run sales or specials on items. These sales apply to in stock items only. No backorders, rain checks or substitutions will be allowed on sale items. The in stock quantity displayed is the quantity that was available when the website was last updated. This information is updated every couple of days. We reserve the right to limit quantities on any sale items. Availability of items may change until the product is shipped. Returns of sale items will be subject to a restocking fee. While we make every effort to ensure accurate information, misprints will sometimes occur. Be sure to check pricing and package quantities when ordering. Some sale prices will have minimum purchase quantities: you must purchase the minimum to get the sale price. Some prices are only available online.
We sometimes sell used parts. Used parts are not returnable unless defective. Used parts will be in usable condition, but will show some signs of wear & use.
Sending Items to us
If you send machines or parts to us for repair, make sure to include your name, address and phone number, along with what you want done. If you do not, we will not be responsible for any items lost in our warehouse. If you send in drums, please indicate why you are sending them in. We get in a lot of drums, some for recovery, others to be balanced, and some are cores. If you do not send paperwork, it takes us longer to find out what it is here for, and it will take longer for you to get it back. You are responsible for shipping charges, proper packaging, tracking, and insurance.
All returns are subject to a restocking fee. We do not accept any returns without a RMA number. Along with the RMA send a copy of the original invoice. Returns without paperwork will be subject to a 100% restocking fee. No items can be returned after 30 days unless otherwise specified or the item is defective. Special order items cannot be returned. Some items may not be returned such as special order items, non stocking items, electrical items, and machines. You are responsible for shipping charges, proper packaging, tracking, and insurance to US Sander for inspection. Shipping charges are non-refundable. Any credit on account will expire one year from issue date.

Orders that have invoiced to the customer and are refused or returned by the carrier for any reason will be charged an inbound shipping and handling fee equal to or greater than what the carrier charged US Sander LLC to return the shipment. Refused shipments will also be considered returned without a RMA and will fall under the return terms and conditions of US Sander LLC.
We offer a repair service for some machines. We reserve the right to refuse to repair a machine for any reason. Transportation to and from US Sander will be the customer's responsibility. In the event that a customer requests a machine be shipped to them, US Sander works with several common carriers. The customer will be responsible for any shipping fees and packaging costs.
When parts are replaced, the old ones are discarded. If you would like the old parts returned to you instead, you must specify this before the repair is started.
Some symptoms, such as chatter, are difficult to diagnose and repair. We make no guarantee that we will be able to find or fix the problem. In the event that we are unable to fix the problem, the customer will still be responsible to pay the costs of parts and labor.
Due to seasonal high demand, we make no guaranty of completion time. Any dates you are given are only estimates. US Sander shall not be responsible for any loss incurred due to delays in the repair.
In the event a machine we have repaired fails, eligibility for warranty will be determined by US Sander. Transportation to US Sander is the customer's responsibility. After we have assessed, we may determine to cover the costs of returning the machine to the customer. We will not reimburse the costs for the customer to send the machine to US Sander. Further terms for warranties can be found below under the section titled Repair Disclaimer of Warranty
Items made by US Sander
All broken or defective items are to be examined by a US Sander representative. If the item is found to be truly defective, we will repair or replace it at our option. In some cases we may refund your money. We will not warranty any item that was broken through negligence or abuse. Normal wear and tear on items that are considered consumable etc. are not under warranty. You are responsible for shipping charges, proper packaging, tracking, and insurance to US Sander for inspection. Other specific warranties will apply depending on the item purchased.
Items made by a different manufacturer
Warranties on items not made by US Sander will be subject to the manufacturer's warranty policy. If the manufacturer does not authorize a warranty repair, we will not be responsible for any repair or replacement costs. Most manufacturers do not warranty electrical items. We will not warranty any item that was broken through negligence or abuse. Normal wear and tear on items that are considered consumable etc. are not under warranty. You are responsible for shipping charges, proper packaging, tracking, and insurance to US Sander for inspection.
Warranties; Limitation of Liability. CUSTOMER REPRESENTS, ACKNOWLEDGES AND AGREES THAT US Sander LLC HAS NOT MADE ANY REPRESENTATIONS OR WARRANTIES, DIRECT OR INDIRECT, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, INCLUDING WITHOUT LIMITATION, THE DESIGN OR CONDITION OF ANY PRODUCT, OR ANY PRODUCT’S MERCHANTABILITY OR ITS SUITABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, THE QUALITY OF THE MATERIAL OR WORKMANSHIP OF ANY PRODUCT, AND ALL SUCH WARRANTIES ARE EXPRESSLY EXCLUDED HEREBY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL US Sander LLC BE LIABLE TO CUSTOMER FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS AGREEMENT OR ANY PRODUCT PROVIDED TO CUSTOMER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, OR LOSS OF USE, EVEN IF HALO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY WHETHER ANY CLAIM IS BASED UPON BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, PRINCIPLES OF INDEMNITY OR CONTRIBUTION, THE FAILURE OF ANY LIMITED OR EXCLUSIVE REMEDY TO ACHIEVE ITS ESSENTIAL PURPOSE OR OTHERWISE.
Repair Disclaimer of Warranty
DISCLAIMER OF WARRANTY: To the maximum extent permitted by applicable law, repaired products and services are provided “as is” without warranties, conditions, representations or guaranties of any kind, either expressed, implied, statutory or otherwise, including but not limited to, any implied warranties or conditions of merchantability, satisfactory quality, title, noninfringement or fitness for a particular purpose. US Sander LLC does not warrant the operation of its offerings will be uninterrupted or error free. You bear the entire risk as to the results, quality and performance of the service should the service prove defective. No oral or written information or advice given by an US Sander LLC authorized representative shall create a warranty. This disclaimer of warranty constitutes an essential part of the license agreement. You are advised to not solely rely on the repaired products and services for any reason.
